Thomas Agans, 47, was arrested and arraigned Monday in Franklin County Court and released under the supervision of Franklin County probation. The charge followed a Franklin County grand jury handing up an indictment for second-degree assault, felony.
This arrest follows an investigation by the New York State Department of Corrections and Community Supervision, Office of Special Investigations, into an incident at the Malone prison on Dec. 7, 2015.
During the incident, Agans struck an inmate in the face, causing him to suffer a compound jaw fracture, according to state police.
