Massena town planning closed-door meeting for reason not listed in Open Meetings Law

MASSENA -- The Town Council is planning a special meeting tonight with an executive session, but the town supervisor’s explanation for executive session is not permissible under New York State Open Meetings Law.

The board is planning to meet at 5 p.m. in the Town Hall's room 30.

Town Supervisor Steve O’Shaughnessy said the executive session will be “to discuss a contract that if discussed in open session would possibly diminish the value of the asset.” He also said he expects the board to take action.

State law permits a public body to expel the public to talk about “the proposed acquisition, sale or lease of real property or the proposed acquisition of securities, or sale or exchange of securities held by such public body, but only when publicity would substantially affect the value thereof.”

O’Shaughnessy did not return a request for comment.
