Former Potsdam school club advisor takes plea deal on harassment with physical contact charge, 180 days in jail

POTSDAM — A Potsdam Central School employee will likely face six-months in jail after taking a plea deal on accusations of child endangerment and harassment stemming from an incident involving a student.

Dan Davis, who served as club advisor for the Potsdam Positivity Club, accepted a plea deal to satisfy charges of second-degree harassment with physical contact and endangering the welfare of a child.

Under the deal, St. Lawrence County’s District Attorney Office will drop the harassment charge and Davis has pleaded guilty to endangering the child.

Although he has not yet been sentenced for that charge, District Attorney Gary Pasqua says the agreed upon sentence is 180 days in St. Lawrence County Correctional Facility.

An order of protection has also been issued for the victim.

The harassment charges included physical contact. Some media have reported that the incident included comments and touching that made the student feel uncomfortable.

Additionally, Davis pled guilty to violating the terms of his probation and will serve 60 days in jail that will be concurrent with his other sentence and will remain on probation.

According to court documents obtained by North Country This Week, Davis was convicted on May 10 for violation of probation stemming from a previous incident.

The documents say Davis was convicted of second-degree reckless endangerment on March 2, 2022 and sentenced to three years of probation supervision stemming from the incident.

Davis subsequently violated his probation on March 24, documents show.

The court report states, “On March 24, 2022, this Department filed a Uniform Court Report communicating the defendant had left St. Lawrence County without prior approval, and went to a restaurant which serves alcohol for on premise consumption also without prior approval. Subsequently, the Court ordered this Department to file a Violation of Probation (VOP).” The probation officer, Joseph Montgomery, filed the directed violation of probation on March 31, 2022.

Davis is to turn himself in to the facility by 5 p.m. on Friday, May 13.
