Clarification: Information regarding the sentencing has been updated to more accurately describe the sentencing for both defendants.
OGDENSBURG – Two men accused of attacking another man last Halloween causing his hospitalization have pled guilty to felony charges and are awaiting sentencing.
Michael Nugent, 30, Ogdensburg, pleaded guilty felony second-degree attempted assault to satisfy the charges against him. He will be sentenced to 2 to 4 years in state prison being eligible for SHOCK.
Both men had originally faced charges of second-degree assault.
Steven Horton Jr., 29, of Brier Hill, pleaded guilty to second-degree strangulation satisfying the charges against him. He received a sentence promise of no worse than 2.5 years.
Nugent and Horton assaulted Anthony Rybka at DaVinci's Tavern in Ogdensburg on Halloween night.
Rybka was left with shattered orbital bones that required titanium plates.
Nugent managed to evade capture until April.
In a recent interview with WWNY the victim said he was upset with the plea agreements reached between the defendants and the district attorney’s office.
