Ogdensburg City Council discusses employment issue during executive session

OGDENSBURG -- Ogdensburg City Council held executive sessions before and after its regular meeting Tuesday to discuss the employment history of at least one member of the city’s staff.

An executive session was also held at the Feb. 26 meeting for the same reason.

Ogdensburg officials did not disclose what individual or department was being discussed and stated that no action was being taken as a result of the discussions.

City council also noted that the executive session following the meeting would include discussion of matters that would imperil public safety if disclosed.

Ogdensburg City Council regularly uses executive session to discuss matters behind close doors, which is allowed under state law in some instances. However any actions taken by the board must be made public.

According to New York State’s open meetings law, minutes, which are a summary of action from the meetings, shall be taken at executive sessions of any action that is taken by formal vote.

Those minutes must be made available to the public within one week from the date of the executive session.

Items permissible to be discussed in executive session include:

• matters which will imperil the public safety if disclosed;

• any matter which may disclose the identity of a law enforcement agent or informer;

• information relating to current or future investigation or prosecution of a criminal offense which would imperil effective law enforcement if disclosed;

• discussions regarding proposed, pending or current litigation;

• collective negotiations pursuant to Article 14 of the civil service law;

• the medical, financial, credit or employment history of a particular person or corporation, or matters leading to the appointment, employment, promotion, demotion, discipline, suspension, dismissal or removal of a particular person or corporation;

• the preparation, grading or administration of examinations; and

• the proposed acquisition, sale or lease of real property or the proposed acquisition of securities, or sale or exchange of securities held by such public body, but only when publicity would substantially affect the value thereof.
