MASSENA -- The Town Council has moved its April meeting to April 11 and will hold a special meeting on March 27.
Town Supervisor Steve O'Shaughnessy said the special meeting will be to discuss the asset transfer negotiations with Massena Memorial Hospital.
Councilman Thomas Miller said he won't be able to attend, but wants to participate via phone or Skype.
Typically, board members are not allowed to participate in meetings from a remote location, unless it's done by video conference and the video conference location is open to the public and announced in advance.
Gustafson said he would make a recommendation as to the best way to participate and stay in compliance with Open Meetings Law.
“It’s executive session. There are rules," he said. “Most circumstances you’ll have a quorum and won’t be voting."
Miller said he feels it's "crucial" that he hears what the attorneys will have to say in executive session.
The asset transfer deal, which the supervisor describes as a real estate transaction with a value that could be diminished by being negotiated in public, is acceptable to discuss in executive session, according to the Open Meetings Law.
“I don’t expect to take any official action, any action," O'Shaughessy said.
The supervisor will be out of town for the regular meeting's original date, which was April 18.
