OGDENSBURG -- A candidate for Ogdensburg City Judge is accused by an artist of using -- without permission -- work she created for the other candidate in the Republican primary Sept. 14.
Sherri Baker of Fairport, near Rochester, has sent a letter to candidate William Small saying that he has “made an unauthorized use of my graphic art work which I designed exclusively for ‘Mary Rain for Ogdensburg City Court Judge.’
“The post card that you are using in your campaign is essentially identical to my graphic design and clearly used my graphic skills,” Baker said in the letter to Small.
“As you neither asked for, nor received, permission to use my design...as the basis for your post card, I believe you have willfully infringed on my rights.”
Baker is demanding that Small “immediately cease the use and distribution of all infringing works,” and that Small destroy or send to her any unused copies, “and that you desist from this or any other infringement of my rights in the future.”
Baker says she expects to hear from Small soon, and if not, she will “take further action against you.”
